The petitioner, who was arrested and remanded to judicial custody on 22.06.2025 for the offences punishable under Sections 8(c) read with 20(b) (ii)(C) of NDPS Act, 1985 in Crime No.136 of 2025, registered on the file of the respondent police, seeks bail. The earlier bail application of the petitioner was dismissed by this Court, vide order dated 02.12.2025 in Crl.O.P.No.32884 of 2025 for the following reasons: "5.

I have gone through the FIR and other connected records, which revealed that the petitioner was arrested with contraband near Vadapalani Bus Stand and it is also stated that it was transported from Odisha. The petitioner has not made out any grounds to satisfy Twin Conditions of Section 37 of NDPS Act. Hence, I am not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed. " 2.

The learned counsel appearing for the petitioner submitted that the petitioner is in judicial custody since 22.06.2025; that the investigation of this case was completed and final report filed, however the trial of this case is not progressing; that the petitioner has no previous cases; and that the petitioner is ready to abide by any condition that may be imposed by this Court, hence prays to grant bail to the petitioner. 3.

The learned Government Advocate (Crl. Side) appearing for the 2/4

respondent submitted that the contraband seized from the petitioner herein is commercial quantity and the petitioner has not made out any grounds for satisfying the Section 37 of the NDPS Act; and that the trial is progressing and the case is posted for examination of P.W.1 on 03.03.2026, hence opposed to grant bail to the petitioner.

Considering the fact that this is the successive bail petition filed by the petitioner without any change in circumstances after dismissal of the earlier bail petition in Crl.O.P.No.32884 of 2025 and the fact that the petitioner has not made out any grounds to satisfy the conditions contemplated under Section 37 of the NDPS Act, hence this Court is not inclined to grant bail to the petitioner.
