Respondents Petition filed under Article 226 of The Constitution of India praying for the issuance of a writ of certiorarified mandamus to call for the records relating to the orders of the first respondent dated 12.12.2017 in M.A.No.864/2017 and O.A.No.739 of 2017, confirming the orders of the second respondent issued in proceeding F.No.8-8/2015-CCRS/Estt/in office order No.10/2017-18 dated 12th April 2017 and pursuant to the order dated 16.05.2017 in Proceeding No.F.No.2721/2017/CCRS/Estt/22/(L) in Office Order No.39 of 2017 and quash the same and to issue consequential directions to the second respondent to repost the petitioner at Chennai and allow the petitioner to continue in the said station so as to enable petitioner to complete the Ph.D. Course.

ORDER

(Order of the Court was made by M.M.SUNDRESH, J.) Challenging the order of the first respondent dated 12.12.2017, confirming the orders of the second respondent dated 12.04.2017 and pursuant to the order dated 16.05.2017 in Proceeding No.F.No.27-21/2017/CCRS/Estt/22/(L) in Office Order No.39 of 2017 and to issue consequential directions to the second respondent to repost the petitioner at Chennai and allow the petitioner to continue in the said station so as to enable petitioner to complete the Ph.D. Course, the present writ petition has been filed.

2.Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the second respondent. 3.Learned counsel appearing for the petitioner submitted that the petitioner being a lady and her husband is working in Chennai, her request may be directed to be reconsidered once again in the light of the subsequent development viz., there are available vacancies in the same post.

4.In such view of the matter, the petitioner is directed to make a fresh representation to the second respondent, who shall consider the same within a period of four weeks from the date of receipt of a copy of this order. The second respondent shall also take into consideration the fact that the petitioner is pursuing Ph.D. course. The writ petition is disposed of accordingly. No costs. Consequently, connected miscellaneous petition is closed.
