ORDER

The petitioner, who was arrested and remanded to judicial custody on 24.11.2025, for the alleged offence punishable under Sections 103(1) of BNS Act in Crime No.735 of 2025 on the file of the respondent police, seeks bail.

2. The allegation against the petitioner is that the petitioner is ranked as A1 in this case and there is a previous motive regarding the murder of A1's sister's daughter on 19.11.2025. The other accused went to the house of the deceased, under the pretext of consuming liquor, brought him to a graveyard, and while consuming liquor, petitioner and other accused attacked the deceased with a knife indiscriminately and severed his head, thereby committing murder. Hence, the case has been registered.

The learned counsel for the petitioner submitted that in the FIR itself, there is no mention about the petitioner, and the other accused only took the deceased to a lonely place, and the petitioner has been falsely implicated in this case due to previous enmity, and is ready to cooperate with the investigation. Hence, he prayed for grant of bail to the petitioner.

The Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the petitioner has a specific overt act of attacking the deceased with a knife and subsequently severing the head of the deceased, and in this case, the investigation is concluded and the final report is also filed, and the same is taken on file in PRC No.1 of 2026. Hence, he opposed for grant of bail to the petitioner.

Considering the fact that the petitioner has specific overt act, and the petitioner brutally attacked the deceased and committed murder, and though it is stated that the investigation is concluded, considering the gravity of the offence and other circumstances, this Court is not inclined to grant bail to the petitioner.
