These Civil Revision Petitions are filed, challenging the interim order of attachment granted in an application filed by the Arbitrator under Section 17 of the Arbitration Act.

2. It is the case of the petitioner that he is the third party to the Arbitral proceedings and the name of the petitioner and that of the first respondent/borrower in the Arbitral proceedings are one and the same.

3. In view of the similarity in the name, his property was wrongfully attached by the interim order passed by the Arbitrator on the belief property belongs to the second respondent/borrower.

4. In view of the fact narrated above, the petitioner herein is an aggrieved party and consequently, he is entitled to file Civil Revision Petition. Therefore, the leave petitions are allowed.

5. Registry is directed to numbering the dispense with petition. Post the matter on 29.11.2022.
