This application has been filed seeking to combine the cause of action.

2. The learned counsel appearing for the applicant submits that there is an infringement of trade mark, copyright and passing off and therefore, in order to avoid multiplicity of proceedings, the cause of actions may be combined in one suit as the parties are the same.

3. Considering the submission made by the learned counsel for the applicant and by taking note of the averments made in the affidavit, particularly, by taking note of the fact that the parties are the same, this application is ordered as prayed for.
