This petition has been filed for mandamus seeking to forbear the first and second respondents to execute sale deed/deeds in favour of the respondents 4 to 11, without removing the encroachment made by the respondents 4 to 11 in 30 ft wide private street, leading to Vinayagapuram Second Street, where the property of the petitioner is situated, bearing plot No.5, Vinayagapuram Second Street, Elumalai Pillai Nagar, Arumbakkam, Chennai-106.

2. The learned counsel for the petitioner submitted that he has already given change of vakalat and also handed over the entire bundle to the petitioner. Therefore, the Registry was directed to print the name of the petitioner. Accordingly, when the matter is listed today, there is no representation on behalf of the petitioner, through counsel or in person. Therefore, it is clear that the petitioner has no interest to proceed with this Writ Petition.

3. Accordingly, this Writ Petition is dismissed for default. Consequently, the connected Miscellaneous Petition is closed. No costs.
