This Writ Petition has been filed to reissue a new passport in continuation of his existing passport based on his application.

2. When the writ petition was taken up for hearing on 22.02.2024, there was no representation for the petitioner. Therefore, it was posted under the caption 'for dismissal' on 23.02.2024. Even today, when the 1/4

matter is called, there is no representation for the petitioner.

3. The learned counsel for the respondent has filed the counter affidavit stating that based on the application of the petitioner for reissuance of passport, a scrutiny was done. It was found that the petitioner was arrayed as one of the accused in a criminal case. In the earlier writ petition filed by the petitioner, this Court had directed the respondent to verify the status of the criminal case and pass orders within a period of four weeks from the date of receipt of a copy of this order. He would further state that a criminal case against the petitioner is charge sheeted before the Chief Judicial Magistrate, Barasat, West Bengal and the said Court had taken cognizance of the same.

4. Since there is no representation on the side of the petitioner, this Court has no other option except to dismiss the writ petition for nonprosecution. Accordingly, the Writ Petition is dismissed for nonprosecution. No costs. 23.02.2024 Index :Yes/No Speaking /Non speaking order sk 2/4
