THE HONOURABLE MR.JUSTICE V.LAKSHMINARAYANAN and C.M.P.No.5233 of 2023 Deepak .. Petitioner Vs.

Ramya .. Respondent Prayer : The Transfer Civil Miscellaneous Petition is filed under Section 24 of Civil Procedure Code, to withdraw O.P.No.102 of 2022 pending on the file of the learned Principal Sub Judge, Chengalpattu and transfer the same to the file of the Sub Judge, Poonamalle. ORDER

The petitioner/husband seeks for transfer of proceedings in O.P.No.102 of 2022 which is now pending on the file of the learned Principal Subordinate Judge at Chengalpattu to the file of the learned Subordinate Judge at Poonamalle.

2. The wife is a permanent resident of Thirukalukundram. The husband is traveling to Thirukalukundram to contest DVC.No.2 of 2022 and MC.No.11 of 2022. To travel from Thirukalukundram to Chengalpattu is much easier than for a person to travel from Thirukalukundram to Poonamalle. Apart from that, the husband is a permanent resident of West Tambaram which is closer to Chengalpattu than Poonamalle.

3. I am getting an impression that this Transfer Civil Miscellaneous Petition has been filed in order to get the proceedings transferred to Poonamalle and thereby, to harass the wife. Therefore, I am not inclined to accept this transfer petition.

4. Accordingly, this Transfer Civil Miscellaneous Petition stands Page No 2 of 4

dismissed. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
