In a proposed suit seeking declaratory and injunctive relief, the intending plaintiff seeks leave to sue against the 3rd respondent/ defendant before this Court. 2.Learned counsel for the applicant would submit that a substantial portion of the cause of action for the suit arose within the jurisdiction of this Court. 3.Upon considering the above submissions and examining the draft plaint and the affidavit in support of the application and also taking into consideration that the suit is for recovery of money, this application is allowed by granting leave to the applicant to sue the 3rd respondent/ defendant before this Court.
