The learned counsel for the applicant/plaintiff states that so far as this application is concerned, the documents which are now sought to be produced Vide this Application are testimonies of certain individuals in an earlier litigation.

2.He further submitted that he can confront witnesses of earlier litigation if they are available or if they are not available he can produce them under Section 33 of the Evidence Act and therefore, seeks the leave of the Court to withdraw this Application.

3.This Application is dismissed as withdrawn.
