ORDER
The respondent herein, who is the petitioner in main Crl.O.P.No.21012 of 2024, has filed the original petition seeking to transfer the investigation in Crime No.18 of 2023 from the file of the Inspector of Police, V.Kalathur Police station, Perambalur District to some other agency, namely CBCID or any other investigation officer and to expedite the investigation. This court vide order dated 10.12.2024 had directed the Superintendent of Police, Perambalur District to entrust the investigation to some other competent investigating officer who can investigate the case fairly and properly and to file the final report within a period of three months.
2.Thereafter, the extension petition, namely Crl.M.P.No.16300 of 2025 was filed seeking for the grant of extension of time to complete the investigation and to file the final report. This court by order dated 28.08.2025 had granted five months time as prayed for. Now, the present extension petition has been filed since the investigation could not be completed within the period of extension.
3.The learned Government Advocate (Criminal side) for the petitioners and the learned counsel for the respondent are before this court. 4.In paragraph no.18 of the affidavit filed by the Deputy Superintendent of Police, Mangalamedu Sub Division, Perambalur District, the details of the 2/5
investigation so far conducted has been given. It is seen that the police officers have inspected the CCTV cameras in the surrounding areas in the occurrence place under the supervision of the Deputy Superintendent of Police. The police personnel have also inspected the central prisons and interrogated the 34 convicts. Further, the relatives of the deceased were interrogated and their statements were recorded. The finger prints recovered from the crime scene were analysed and reports were received after examining the fingerprints of 72 other suspect individuals.
5.In the light of the above, this court is of the view that though the Deputy Superintendent of Police needs some time to complete the investigation and hence filed this extension petition, this court finds that the investigation needs much rigour and attention. This court leaves it to the wisdom of the Superintendent of Police, Perambalur to have a review of the case diary and if required, he can refer the investigation to a specialised agency. In any event, six months further time is granted, as sought for by the petitioners in this miscellaneous petition, to complete the investigation and to file the final report. This criminal miscellaneous petition is ordered. No costs. 17-06-2026 vvk 3/5
