J U D G M E N T

When the case was taken up for hearing on earlier occasions on 08.11.2021, 09.06.2023, 20.08.2024, 04.09.2024 and 11.09.2024, it was submitted by the learned counsel for the appellants that the second appellant is no more and sought time for taking steps to bring on record the legal representatives of the deceased, second appellant, and this Court directed the Registry to list the matter under the caption "For Dismissal" on 23.09.2024 [today].

2. Even though the appeal is listed under the caption "For Dismissal" today, there is no material to show that the learned counsel for the appellants had taken steps so far, and there is no representation for the respondent herein. Hence, this Court is left with no other option except to dismiss the appeal for non-prosecution.

3. The Second Appeal stands dismissed for Non-Prosecution. No costs.
