Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to (i) To relax the condition imposed upon the petitioner that he should appear before the Trial Court once in three months on the first working day of that month at 10.30 a.m. until further orders in Crl.M.P.No.2335 of 2017 dated 16.02.2017 in Crl.A.No.411 of 2016. Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of M/S. A.V.SOMASUNDARAM, Advocate for the petitioner, and of MR.K.SRINIVASAN, Special Public Prosecutor for CBI-cases, on behalf of the Respondent, the court made the following order:- This petition has been filed to relax the condition imposed on the petitioner by this Court vide Crl.M.P.No.2335 of 2017 dated 16.02.

2017 in Crl.A.No.411 of 2016 that the petitioner should appear before the Trial Court once in three months on the first working day of that month at 10.30 a.m. until further orders. 2.The learned counsel for the petitioner would submit that the petitioner is a senior citizen and suffering from age related medical problems and that he is residing at Bangalore and thereby, he finds it difficult to travel all the way to Chennai. He would further submit that the petitioner has been regularly complying with the condition for the past 4 years and above and thereby, he would seek for relaxation.

3. The learned Special Public Prosecutor for CBI Cases would submit that the petitioner has been asked to comply with the https://hcservices.ecourts.gov.in/hcservices/

condition from the year 2016 and that he did not appear before the Court on 01.04.2017 and also during Corona pandemic period.

4. Taking into consideration the above facts and submissions, the condition imposed on the petitioner by order dated 16.02.2017 in Crl.M.P.No.2335 of 2017 in Crl.A.No.411 of 2016 is modified to that the effect that the petitioner shall appear before the Inspector of Police, CBI, BS&FB, No.36, Bellary Road, Ganganagar, Bengaluru, Karnataka-560032, once in every three months on the first Monday of the particular month at 10.30 a.m. starting from May 2021, until further orders.
