Respondents PRAYER: This Writ Petition has been filed under section 226 of the Constitution of India to issue an order of Writ of Mandamus, to direct the respondents to notionally promote the petitioners to the post of Assistant with effect from the date of completion of 25 years of service of the petitioners in the post of Village Administrative Officer and pay all the pensionary and other retirement benefits, as if, they retired from the post of Assistant from the date of completion of 25 years of service in the post of Village Administrative Officer and all other monetary and service benefits. This writ petition has been filed by two persons, who are retired Village Administrative Officers, seeking a direction to the respondents to notionally promote the petitioners to the post of Assistant with effect from the date of completion of 25 years of service of the petitioners in the post of Village Administrative Officer and pay all the pensionary and other retirement benefits, as if, they retired from the post of Assistant from the date of https://hcservices.ecourts.gov.in/hcservices/
completion of 25 years of service in the post of Village Administrative Officer and all other monetary and service benefits.
2. Mr. S. Gunasekaran, learned Government Advocate takes notice for the respondents.
3. When the matter came up for admission, learned counsel appearing for the petitioner sought for a limited prayer to dispose of the representation given by the petitioners. As both the petitioners have retired from service, from the post of Village Administrative Officers, they have also presented a joint representation dated 10.03.2015 before the second respondent.
4. Considering the limited prayer made by the petitioners, without going into the merits of the matter, the second respondent is hereby directed to consider the representation dated 10.03.2015 and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order.
5. With the above direction, the writ petition is disposed of, at the stage of admission itself. Consequently, connected M.P. is closed. No order as to costs.
