ORDER

The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 303(2) of BNS Act r/w Section 21(1) of Mines and Minerals (Development and Regulation )Act, in Crime No.437 of 2025, on the file of the respondent Police, seeks anticipatory bail.

2. This Court has dismissed the earlier anticipatory bail petition of the petitioner in Crl.O.P.No.356 of 2026 on 12.01.2026 for the following reasons:

Considering the nature of offence committed by this petitioner and that this petitioner had involved not only in quarrying the river sand but also in damaging the environment and ecology and if this petitioner is granted anticipatory bail, he will involve in similar activities and hence this Court is not inclined to grant anticipatory bail to this petitioner.

3. The learned counsel for the petitioner submitted that the petitioner is having valid permit to transport the river sand .

4. However, on perusal of records it is seen that the petitioner had transported river sand from particular one place whereas the vehicle was intercepted in a different place which shows that the petitioner has illegelly taken the sand

In view of the above facts and this is the second anticipatory bail petition and the earlier petition in Crl.O.P.No.356 of 2026 on was dismissed by this Court on 12.01.2026 and there is no change in circumstances, this Court is not inclined to grant anticipatory bail to the petitioner. This Criminal Original Petition stands dismissed . 17.02.2026 smn
