Prayer : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari, to call for the records relating to the Impugned Notice passed by the 2nd respondent dated 23.12.2025 in Na.Ka.No.1453/2025(1) and to quash the same.

ORDER
This writ petition has been filed challenging the impugned notice, dated 23.12.2025 issued by the 2nd respondent to the 4th respondent, requesting for police assistance to conduct the survey and demarcation of boundaries based on the request made by the 6th respondent.
2. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the respondents 1 to 3 and 5 and Mr.R.Venkatesa Perumal, learned Government Advocate (Crl.Side), accepts notice on behalf of the 4th respondent.
3. The petitioner has challenged the impugned notice on the ground that, since a civil suit is pending between the petitioner and the 6th Page No.2 of 6
respondent, survey and demarcation of boundaries cannot take place. The petitioner has also raised other grounds in this writ petition. The petitioner also contends that he has already raised objections with the 2nd respondent and had protested the survey and demarcation of the boundaries, based on the request made by the 6th respondent. Necessarily, the 2nd respondent will have to hear the objections of the petitioner, since a civil suit is already pending between the petitioner and the 6th respondent and only thereafter, the 2nd respondent shall conduct the survey and demarcation of boundaries. The objections that have been raised by the petitioner in this writ petition will have to be raised only before the 2nd respondent.

For the foregoing reasons, this Writ Petition is disposed of by directing the petitioner to submit written objections before the 2nd respondent opposing the survey and demarcation of boundaries to be conducted by the 2nd respondent based on the request made by the 6th respondent, within a period of one (1) week from the date of receipt of a copy of this order. The 2nd respondent shall consider the said written objections if the same is received within the stipulated time and thereafter, decide as to whether the survey and demarcation of boundaries Page No.3 of 6
