..Respondents Writ Petition filed under Article 226 of the Constitution of India seeking issuance of declaring that the impugned amendment to Rule 2(ii)(a) under G.O.Ms.No.288, School Education (PL1) Department dated 9.12.2025 (published in the Tamilnadu Government Gazetee dated 16.12.2025) insofar as it provides for recruitment by transfer from among the holders of the posts of Librarian Grade-I, or Inspector of Libraries is illegal, arbitrary and unconstitutional and is therefore liable to be quashed and the petitioner further seeks a declaration that the said provision be substituted with recruitment by transfer from among the holders of the post of Superintendent of the Local Library Authorities.

ORDER

(Made by S.M.Subramaniam J.) The present writ of declaration has been instituted to declare the amendment to Rule 2(ii)(a) under G.O.Ms.No.288, School Education (PL1) Department dated 09.12.2025 as null and void.

2. The issue raised in the present writ petition is no more res integra. The validity of G.O.Ms.No.288, School Education Department, dated 09.12.2025 in its entirety has been considered by the Division Bench of Madurai Bench of Madras High Court and a judgment was delivered on 29.01.2026 in W.P.(MD) No.1281/2026. The Division Bench has already held that the challenge to G.O.Ms.No.288, School Education Department, dated 09.12.2025, is baseless and without valid reasons. No material is available to infer that by amending the recruitment rules, retrospective effect to temporary/ad hoc postings is likely to be regularized. In view of the fact that the Government Order has already been upheld by the Division Bench of Madurai Bench of Madras High Court, the present writ petition stands dismissed. No costs. Consequently, connected miscellaneous petitions are closed.
