ORDER
The petitioner, who was arrested and remanded to judicial custody on 28.11.2025, for the alleged offence punishable under Sections 140(1), 103(1) of BNS Act @ 140(1), 103(1), 191(2), 191(3), 61(2), 238 of BNS Act, in Crime No.493 of 2025 on the file of the respondent police, seeks bail. 1/4
3. This Court has dismissed the earlier bail petition of the petitioner in Crl.O.P.No.1539 of 2026 on 27.01.2026 for the following reasons:

Considering the fact that the co-accused are still absconding and that the investigation is yet to be completed, this Court is of the view that if the petitioner is released on bail at this stage, there is a likelihood of his indulging in similar activities and it would also hamper the investigation. Therefore, this Court is not inclined to grant bail to the petitioner.
3. The learned counsel for the petitioner submitted that the petitioner is in incarceration from 28.11.2025 and he is ready to co-operate with the investigation and prays to grant bail.
4. This Court has already considered the submissions of the petitioner and dismissed the petition on merits. Now, the present petition has been filed without any change in circumstances after the dismissal of the petitioner's earlier bail petition. This clearly shows that the petitioner has abused the process of law. Hence, I am not inclined to reconsider the earlier order passed by this Court in Crl.O.P.No.1539 of 2026 on 27.01.2026
5. Accordingly, this Criminal Original Petition is dismissed. 25.02.2026 smn 2/4
