Mr.T.M.Rajangam, Government Advocate for R1 to R5 Order This writ petition has been filed to direct the 2nd respondent to consider the representation dated 25.03.2025 to accept the petitioner's surrender of approval of school, as she intended to winding up the school.
2. Case of the petitioner is that her late father-in-law one Mr.R.Dhandapani along with his late friend one Mr.Ramachandiran had established M/s.Vivekanantha Educational Trust for the benefit of public and the same was incorporated on 27.06.2011 by virtue of Trust Deed and the said Trust was running in the name of Vivekanantha Vidhyalaya Nursery School and it was established over the land belonging to his late father in law. After the demise of her father in law and his friend, the petitioner was admitted as Managing Trustee as per the Board Resolution dated 29.06.2024. Due to which, one Poongothai, wife of late Ramachandran had started to create problems over the administration and also claims right over the property. Since the said Poongothai claims right over the property and the school was also running in financial loss, the petitioner was not willing to renew its license. Hence she had sent representation dated 25.04.2025 expressing her intentions to winding up the
school and to accept surrender of approval. Since, no action was taken on her representation, she has approached this Court by filing this writ petition.
3. The learned counsel appearing for the petitioner would submit that it would suffice, if the second respondent is directed to dispose of the representation of the petitioner dated 25.04.2025 on merits and in accordance with law, within a specified period.
4. The learned counsel appearing for the respondents has no objection for such an order being passed by this Court.
5. Heard the learned counsel appearing for the petitioner and learned counsel appearing for the respondents.
6. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without going into the merits of the case, directs the second respondent to consider the representation of the petitioner dated 25.04.2025 and pass appropriate orders on merits and in accordance with law within a period of six weeks from the date of receipt of a copy of this order.
7. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
