Mr.A.Gopinath Government Advocate(Crl. Side) COMMON ORDER The petitioners, who were arrested and remanded to judicial custody on 16.01.2026, for the offences punishable under Sections 303(2) @ 303(2), 314, 316(2), 317(2), 336(3), 340(2) of BNS in Crime No.16 of 2026, registered on the file of the respondent police, seeks bail. 2.The allegation against the petitioners is that, the petitioner in Crl.O.P.No.3562 of 2026 is ranked as A4 and the petitioner in Crl.O.P.No.3557 of 2026 is ranked as A5 and they colluded and booked the car on rental basis by online app after receiving the car they clandestinely change the engine and chasis number and sold it to other accused. Hence, the petitioners were arrested. 3.The learned counsel appearing for the petitioner/A4 submitted that originally the car was parked in the premises of A4, on the instigation of A5, he was not aware about the involvement of other accused in these activities and he has been falsely implicated. Hence prays for grant of bail to the petitioner.
4.Similarly, the learned counsel appearing for the petitioner/A5 submitted that the petitioner is in incarceration and already the car is also recovered and there is no previous cases pending against the petitioner. Hence, prays for grant of bail to the petitioner.
5. The learned Government Advocate (Crl. Side) appearing for the respondent reiterated the prosecution case and submitted that petitioners are not having any previous case and the car has been recovered and the investigation is pending. Hence, opposed for grant of bail to the petitioners.
6. Considering the nature of the allegation and the car already recovered and some of the accused have arrested and the petitioners are not having any previous case, this Court is inclined to grant bail to the petitioners with certain conditions.
7. Accordingly, the petitioners are ordered to be released on bail on their executing a separate bond for a sum of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties, each for a like sum to the satisfaction of the learned Judicial Magistrate, Palladam, and on further conditions that:- [a] the sureties shall affix their photographs and Left Thumb Impression in the surety bond and the Magistrate may obtain a copy of their Aadhar card or Bank pass Book to ensure their identity;
[b] the petitioners shall report before the respondent police daily at 10.30 a.m., for a period of four weeks.
[c] the petitioners shall not abscond either during investigation or trial;
[d] the petitioners shall not tamper with the evidence or witness either during investigation or trial; [e] On breach of any of the aforesaid conditions, the learned Magistrate/Trial Court is entitled to take appropriate action against the petitioners in accordance with law as if the conditions have been imposed and the petitioner released on bail by the learned Magistrate/Trial Court himself, as laid down by the Hon'ble Supreme Court in P.K.Shaji vs. State of Kerala [(2005)AIR SCW 5560];
[f] If the accused thereafter absconds, a fresh FIR can be registered under Section 269 B.N.S.
