2 ARUN KUMAR @ SANTHANA ARUN Petition praying that in the circumstances stated therein the High Court will be pleased to pleased to direct the 2nd respondent / accused to comply with the order dated 21.10.2021 passed in Crl.O.P.No.17708 of 2021.

Order : This petition coming on for orders upon perusing the petition and upon hearing the arguments of M/S. SHAIKH MEHRUNNISA KASIM, Advocate for the petitioner and of MR. S.UDHYAKUMAR, Govt. Advocate(Crl. Side)on behalf of the Respondent the court made the following order:- The petitioners have filed this petition seeking to direct the second respondent/ accused to comply with the order dated 21.10.2021 passed in Crl.O.P.No.17708 of 2021.

2.Since the second respondent/ accused on his own volition agreed to deposit the conditional amount, this Court vide order dated 21.10.2021 passed in Crl.O.P.No.17708 of 2021 granted anticipatory bail to the second respondent/ accused on condition that the second respondent shall make a non refundable deposit of Rupees One Crore Two Lakhs Fifty Thousand Three Hundred and Sixty Eight Only and the said amount shall be disbursed in favour of the victims. Since the said condition has not been complied with by the second respondent, the petitioners have filed this petition.

3.Heard the learned counsel appearing for the petitioners. 4.The learned Government Advocate (Crl. Side) submitted that the second respondent/ accused has not complied with the said condition. 5.Though the name of the learned counsel who appeared on behalf of the second respondent/accused, while granting anticipatory bail, has been printed in the cause list, today (23.03.2022) when the matter is taken up for consideration, there is no representation for the second respondent.

6.For non-compliance of the aforesaid condition, the anticipatory bail granted to the second respondent/ accused on 21.10.2021 in Crl.O.P.No.17708 of 2021, is hereby vacated. 7.This criminal miscellaneous petition is accordingly allowed. -sd/- 23/03/2022 This order, on being produced, be punctually observed and carried into execution by all concerned TRUE COPY Sub-Assistant Registrar (Statistics/C.S.)
