O R D E R
The petitioner, who was arrested and remanded to judicial custody on 11.10.2025, for the alleged offence punishable under Sections 3(a), 4(1), 5(1), 5(j)(ii) r/w 6 of POCSO Act, 2012 in Cr.No.54 of 2025 on the file of the respondent police, seeks bail.

2. The allegations against the petitioner is that the petitioner herein is the neighbour of the victim girl. Taking advantage of her being alone and under the pretext of promising to marry her, had taken away into his house and committed aggravated penetrative sexual assault and also criminally threatened her to continue the same. Subsequently, the defacto complainant/mother of the victim girl, lodged a complaint against the petitioner, which led to the registration of the case. and thereby, the petitioner was arrested. Hence, the present petition has been filed seeking bail.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent and he has not committed any such offence as alleged by the prosecution. He further submitted that the petitioner is in custody from 11.12.2025 and he is ready to cooperate with the investigation and also ready and willing to abide by any conditions that may be imposed by this court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Crl.Side) appearing for the respondent police reiterated the prosecution case and submitted that the it is 2/4
a case of aggravated penetrative sexual assault and he has also produced the statement of victim girl recorded under Section 183 of BNSS and opposed to grant bail to the petitioner.
5.I have also gone through the statement recorded from the victim girl, wherein, she has narrated the entire incident, including the way, in which, she was subjected to sexual assault by the petitioner herein.
6. Since its a case of committing aggravated penetrative sexual assault on the victim child and considering the other facts and the investigation in this case is pending, I am not inclined to grant bail to the petitioner.
7. Accordingly, this Criminal Original Petition is dismissed. 13.02.2026 Vv To
