The Official Liquidator High Court, Madras as the Liquidation/Provisional Liquidator of Various Companies under Liquidator ...Applicant The Company Applicant praying this Court:- a)To fix the advocate fee as per the list attached in Annexure-B or as this Hon'ble High Court may deem fit and proper.

b) To pass on order permitting the Official Liquidator to utilize the services of the said advocates for the purpose of appearance before various Courts and Tribunals on behalf of the Official Liquidator as and when the necessary arises. c) To permit the Official Liquidator to incur the cost of the application from out of the Common Pool Fund Account maintained by the Official Liquidator.

The Company Application coming on this day before this Court, Advocates for the applicant herein and Mr.P.Achutha Ramiah,Official Liquidator High Court, Madras for the Applicant herein and upon reading the Judge's Summons and report filed herein, the Court made the following order:-

"This application has been filed by the learned Official Liquidator seeking fixation of fee as per the list attached in Annexure B. Apart from the same, a prayer has been sought for to utilise the services of the learned counsels for the purpose of appearance in various forums. Incidentally, the learned Official Liquidator sought permission to incur the cost of the application from out of the Common Pool Fund Account.

2.This Court perused the Annexure B. The fee structure has been fixed long time ago.

3.Considering the above and taking note of the escalation of price, this Court is of the view that this application deserves to be allowed. Insofar as prayer (c) is concerned, the same also stands allowed. Consequently, the learned Official Liquidator is permitted to incur the cost of the application out of the Common Pool Fund Account maintained by him".
