Respondents Petition under Section 11 of the Contempt of Courts Act, 1971 praying to punish the respondents for disobedience of the order of this Court dated 26.7.2011 made in W.P.No.29499 of 2002.

ORDER

When the contempt petition was taken up, the learned Special Government Pleader for the second respondent, placing on record the proceedings dated 25.1.2017 issued by the Chief Educational Officer, Tirunelveli observing as

follows, "1. As the School which the Applicant in Contempt Proceedings namely Tmt.Sundaravalli is only a Middle School affecting her promotion opportunities, she is transferred to St.Michael Girls Higher Secondary School, Tenkasi with protection for pay and seniority.

2. Her service is regularised with effect from the date of reinstatement with all benefits as per the order of the Hon'ble High Court in W.P.No.29499/2002 dated 26.7.2011.

3. The Salary and other benefits if any left out will be settled as per the fundamental rules."

submitted that now the petitioner will be transferred to St.Michael's Girls Higher Secondary School, Tenkasi, therefore, he requested this Court to close the contempt petition.

However, Mr.R.Singaravelan, learned senior counsel for the petitioner submitted that the contents of the first paragraph of the proceedings throwing several allegations are denied. The said statement is recorded.

2. In view of the above, this contempt petition stands closed. The first respondent shall ensure that all the service certificates of the petitioner are transferred to St.Michael's Girls Higher Secondary School, Tenkasi within

a period of one week.
