ORDER : The Court Made the following order :- The petitioners who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 341, 294(b), 323 and 506(ii) of IPC in Crime No.48 of 2021 on the file of the respondent police, seek anticipatory bail.

2. The case of the prosecution is that the defacto complainant is the owner of the property. When the defacto complainant demaned the rental amount from the petitioners(tenants), they assualted the defacto complainant and caused injury to her. Based on the complaint lodged by the defacto complainant, the respondent police has registered a case.

3. The learned counsel appearing for the petitioners submitted that the petitioners are innocent and they have been falsely implicated in this case and prayed for grant of anticipatory bail.

4. The learned Additional Public Prosecutor submitted that the investigation is still pending. Therefore, he opposed to grant anticipatory bail to the petitioner.

5. Taking into consideration the allegations and also the fact that the case is in the initial stage of the investigation and that the custodial interrogation of the petitioners are essential, this Court is not inclined to grant anticipatory bail to the petitioners.
