This Criminal Original Petition has been filed seeking to quash the First Information Report in Crime No.151 of 2022 pending on the file of the first respondent.
When the matter was taken up on 13.02.2026, this Court, considering that there is a bar under Section 468 Cr.P.C. for taking cognizance, passed an order allowing the petition. However, before signing the order, upon perusal of the records, this Court found that the final report had been e-filed within the period of limitation. In view of the same, the matter was directed to be posted today under the caption "for clarification". 3.
The learned Government Advocate (Criminal Side) submitted that based on the complaint lodged by the second respondent, the aforesaid case in Crime No.151 of 2022 was registered on 04.04.2022 for the offences under Sections 294(b), 279, 337 and 353 of IPC against the petitioner. It is alleged that on 04.04.2022, when the second respondent/de facto complainant was conducting a vehicle inspection, the petitioner/accused arrived at the place of occurrence on his two-wheeler at a high speed and when the same was questioned by the second respondent, the petitioner abused the de facto complainant/R2 using filthy language and attempted to 2/5
escape, during which process, the de facto complainant/R2 sustained injuries. She further clarified that the occurrence is stated to have taken place on 04.04.2022 and the period of limitation for filing the final report is three years as per Section 468(2)(c) of Cr.P.C. The final report was e-filed on 19.09.2024 before the learned XVIII Metropolitan Magistrate, Saidapet, in LTN20230001145C202400207, which is well within the period of limitation and hence, the prayer sought in this petition become infructuous. 4.
Having heard the learned counsel appearing on either side and upon perusal of the materials available on record and finding that the final report has been filed within the period of limitation, this Court is of the view that the ground raised by the petitioner with regard to limitation cannot be sustained. Therefore, this Court is not inclined to allow this petition. 5.
Accordingly, this Criminal Original Petition stands dismissed. Consequently, the connected miscellaneous petition is closed. However, the petitioner is at liberty to challenge the final report in the manner known to law, if so advised.
