Learned counsel for the respondents Mr.Bala would submit that the Government has referred the issue to a Committee, headed by a retired High Court Judge and by accepting the recommendation of the Committee, the
Government had issued G.O.(D) No.607, Municipal Administration and Water Supply Department dated 17.10.2025. The relevant portion of the Government Order reads as under.
10. The Government, after careful examination of the matter in consultation with the Litigation Advisory and Oversight Committee (LAOC) in the Finance Department, have decided to accept the recommendations of the Committee (LAOC) and the consent given by the petitioners. Accordingly, the Government hereby permit the Commissioner, Greater Chennai Corporation to take necessary action in the light of the recommendations of the Litigation Advisory and Oversight Committee as detailed below:- (i) To grant regular time scale of pay to the petitioners in W.A.Nos.468, 469 & 473 of 2025 from the date of completion of three years from their initial appointment on consolidated pay (NMR);
(ii) To sanction 40% of the arrears of pay as full and final settlement to the above petitioners;
(iii) To extend the offer made in para 10(i) & (ii) above to all other similarly placed employees (NMRs), both litigants and non-litigants in Greater Chennai Corporation, who are covered under the Minutes of the meeting fifth read above, in order to ensure uniformity and early settlement of longpending claims; (iv) To issue notices to the employees concerned, indicating the settlement terms and stipulating a time limit for their response. Non-response within the stipulated time will be construed as consent to receive 40% of the arrears to pay as full and final settlement;
(v) To finalise payments after verifying the identity and eligibility of such employees;
(vi) To furnish a compliance report to Government at the earliest.
11. It is further ordered that this Government Order shall not be construed or treated as a precedent for any
other employees similarly engaged, or for any other category of employees serving under the State Government or any local body.
2. In view of the above position, no further adjudication on merits needs to be undertaken in respect of the present Writ Appeal. Accordingly, the Writ Appeal stands closed. No costs. Consequently, connected miscellaneous petition is closed.
