PRAYER: This writ petition has been filed under Article 226 of the Constitution of India for issuance of Writ of Certiorarified Mandamus calling for the entire records pertaining to the appointments made towards the post of Assistant Surgeon (General-MBBS) conducted by the Medical Services Recruitment Board, the 1st respondent herein and quash Section 9(d) of Notification 1/2013 titled Instruction to Candidates and Corrigendum dated 09.04.2013 amending Section 9(d) both issued by the 1st respondent as arbitrary and unreasonable being violative of rules and principles of natural justice and consequentially direct the 1st respondent herein to declare the PROVISIONAL LIST OF FINAL SELECTED CANDIDATES dated 21.08.2013 as invalid and to prepare a fresh list of candidates including the petitioner.

When this writ petition came up for consideration before this Court on 15.10.2024, there was no representation for the petitioner and the same was listed under the caption "for dismissal" on 21.10.2024.
Today, in spite of the matter being listed under the caption "for dismissal", there is no representation for the petitioner either during prelunch session or post lunch session. In the circumstances, this Court is left with no other option except to dismiss the same for non-prosecution. Accordingly, the writ petition is dismissed for non-prosecution. No costs.
