S.Ethirajammal v. The District Collector

The so called final compliance report has been filed by the District Collector, Vellore on 02.07.2015 stating that the minor ups and downs noticed in the tank water spread area during the inspection carried out on 16.06.2015 have now been completely levelled and restored by the Water Resource Department, Upper Palar Basin Division, Vellore.

2. On the other hand, the learned counsel for the petitioner seeks to produce certain photographs to show that the work is not complete.

3. We are inclined to let the matter be looked into by the State Environmental Impact Assessment Authority, but we are informed that this authority has seized to function from April, 2015, there being no Chairman or Member. In this behalf, it is stated that it is the State Government who has to forward the proposal to the Ministry of Environment and Forests, Government of India, New Delhi.

4. The learned Government Pleader states that he will obtain instructions as to whether the names have or have not been forwarded.

5. In order to have a better supervision of this issue, as an interim measure, we call upon the Commissioner, Department of Geology and Mining to remain present in Court on the next date of hearing.

6. It appears that as usual, the blame is sought to be put on the lower rank of the ladder as it is stated that the persons suspended in anticipation of the disciplinary proceedings are at the end of the ladder and this matter should be looked into by the Secretary, Industries Department to ensure that there is a meaningful enquiry in fixing the responsibility and an affidavit be filed by him before this Court within two weeks.

7. List on 20.08.2015.

8. Respondent No.7 to remain present in Court on the aforesaid date.
