ORDER

The petitioner, who was arrested and remanded to judicial custody on 25.11.2025 for the offences punishable under Sections Girl missing @ Section 87 of BNS, U/s. 3(a) r/w. 4(2), 5(l) r/w. 6 of POCSO Act in Crime No.776 of 2025 on the file of the respondent police, seeks bail. 2.

The allegation against the petitioner herein is that, the petitioner was working as a driver in De-Addiction Centre, situated near the victim girl's house; that somehow the petitioner had developed contact with the victim girl, who is aged about 15 years, kidnapped and took her to his friend's house and forcibly committed penetrative sexual assault in spite of the resistance from the victim girl. Hence, this case.

The learned counsel appearing for the petitioner submitted that the petitioner has been falsely implicated in this case and he has not committed any offence as alleged by the prosecution; that the petitioner is in judicial custody since 25.11.2025; and that the petitioner is ready to abide by any condition that may be imposed by this Court and sought for bail to the petitioner. 2/4

The learned Government Advocate (Crl. Side) appearing for the respondent while opposing the bail to the petitioner reiterated the prosecution case and submitted that the petitioner herein is aged about 32 years and the victim girl is aged about 15 years; that the petitioner had got acquaintance with the victim girl, kidnapped her and committed penetrative sexual assault on the victim girl; that the statement of the victim girl is recorded; and that the investigation of this case is pending.

I have considered the submissions made on both sides and perused the materials available on record, including the statement recorded from the victim girl, which reveals that the petitioner not only committed penetrative sexual assault on her, but also forced the victim girl to take money from her house and also threatened her of dire consequences 6.

Considering the above facts, the offence committed by the petitioner herein and taking note of the fact that the investigation of this case is pending, this Court is not inclined to grant bail to the petitioner. 3/4
