Pachaiammal v. Sengamma Naidu

CMP.Nos.5609 & 5610/2022 in SA.Nos.78 & 79/2017 S.S.SUNDAR, J., The learned counsel appearing for the petitioners in the above two miscellaneous petitions states that he does not hold Vakalat for the legal representatives of the deceased 1st appellant, who are also shown as petitioners 5, 6 & 7.

2.It is not known as to how petitions could be filed without Vakalat for petitioners 5, 6 & 7. In such circumstances, it is open to the petitioners 1 to 4 to file a petition either showing petitioners 5, 6 & 7 as respondents or file a petition including petitioners 5, 6 & 7 after getting Vakalat from them so that these petitions can be ordered.

3.The learned counsel for the petitioners seeks permission of this Court to withdraw the above petitions with liberty to file appropriate petitions.

4.Hence, the above Civil Miscellaneous Petitions are dismissed as withdrawn. However, liberty is granted to the petitioners to file appropriate petitions after getting instructions or after getting Vakalat from the proposed parties.
