Vs C.SWAMINATHAN [ RESPONDENT/PETITIONER ] Petition praying that in the circumstances stated therein and in the affidavit filed therewith the High Court will be pleased to extend the time for a further period of 6 months to complete the investigation and to file a final report as per the directions given by this Hon'ble High Court by its order dated 16.08.2021 made in Crl.M.P. No.6705 of 2021 in Crl.O.P. No.7005 of 2019 and thus render justice.

Order : This petition coming on for orders upon perusing the petition and the filed in support thereof and upon hearing the arguments of PUBLIC PROSECUTOR, Advocate for the petitioner the court made the following order:- This petition is filed seeking extension of time for further period of six months to complete the investigation and to file final report as per the directions of this Court, dated 16.08.2021, in Crl.M.P.No.6705 of 2021 in Crl.O.P.No.7005 of 2019.

2.The learned Additional Public Prosecutor submitted that the scrutiny committee's report was received. Due to intervening Covid-19 situation, investigation in this case could not be completed. Therefore, seeks time as aforesaid.

3.The learned counsel for the respondent opposes this petition on the ground that direction was issued to complete the investigation as early as on 06.12.2019, giving four months time. Till now, the investigation is not completed. Therefore, he opposes the prayer for extension of time.

4.Considered rival submissions and perused the records. 5.Considering the reasons stated by the petitioner, intervening Covid-19 pandemic situation, also fact that there is some progress in the investigation (Scrutiny Committee's report is received), this Court extends further period of four months from today (i.e. 05.04.2022) for completion of investigation and for filing final report. It is made clear that no further extension of time will be granted.
