The petitioner, who was arrested and remanded to judicial custody on 09.01.2023 for the offences punishable under Section 379 of IPC in Crime No.5 of 2023, on the file of the respondent police, seeks bail.

2.The case of the prosecution as per the defacto complainant is that she along with her family members went to Chidambaram temple for worship. At that time, there was rush in the temple and someone has snatched the gold chain weighing about 6 sovereigns which was wore by the mother-in-law of the defacto complainant. Hence the complaint. 3.Learned counsel for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that he has nothing to do with the alleged offence and the petitioner is ready to abide by any stringent condition that may be imposed by this Court. He also submitted that the petitioner is in

judicial custody from 09.01.2023 and hence, he prayed to grant bail to the petitioner.

4.Learned Government Advocate (Crl.Side) for the respondent submitted that the defacto complainant along with her family members went to Chidambaram temple for worship. At that time, there was rush in the temple and the petitioner has snatched the gold chain weighing about 6 sovereigns which was wore by the mother-in-law of the defacto complainant. He further submitted that there are six previous cases, similar in nature, pending against the petitioner and the property was not recovered and if the petitioner is released on bail at this stage, he would tamper the witness and hamper the investigation. Hence, he vehemently opposed to grant bail to the petitioner.

5.Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) for the respondent and perused the materials available on record.

6.Considering the facts and circumstances of the case and the submissions made by both counsel and also taking note of the fact that the property was not recovered and the investigation is not yet completed, this Court is not inclined to grant bail to the petitioner. 7.Accordingly, this Criminal Original Petition is dismissed. 01.03.2023 vkr
