(Order of the Court was made by P.N.PRAKASH,J.) By order dated 15.09.2022, we directed the police to serve notice on Mathu (A22)/R11 and produce him before the trial Court for the purposes of executing a bond under Section 88 Cr.P.C. However, the learned Additional Public Prosecutor submitted that Mathu (A22)/R11 died on 09.03.2019.

Recording the same, the prosecution against Mathu (A22)/R11 stands abated.

Heard the learned counsel on both sides.

Being satisfied with the reasons assigned in the affidavit filed in support of this petition, the delay of 616 days in filing the above appeal is condoned.
The Registry shall number the leave petition, if the same is otherwise in order.
