Criminal Revision Case is filed under Section 438 r/w 442 of BNSS, praying to call for the records pertaining to the order dated 11.06.2024 in Crl.MP.No.27388 of 2024 passed by the XIII Metropolitan Magistrate Court, Egmore, Chennai 600 008, set aside the same and allowing this criminal R.C. petition.

O R D E R
This criminal revision case has been filed against the order dated 11.06.2024 passed in Crl.MP.No.27388 of 2024 by the XIII Metropolitan Magistrate Court, Egmore, Chennai, thereby closed the petition filed under Section 156(3) of Cr.P.C.

The petitioner had lodged a complaint. However, there was no
action and as such, the petitioner filed petition under Section 156(3) of Cr.P.C. in Crl.MP.No.27388 of 2024. By order dated 06.05.2024, the learned XIII Metropolitan Magistrate Court, Egmore, Chennai directed the respondent to conduct enquiry and submit report on or before 11.06.2024. Thereafter, on 11.06.2024, the petition was closed on the ground that already direction was issued to conduct investigation. As directed by the learned Magistrate by an order dated 06.05.2024, the respondent conducted enquiry and closed the complaint. The respondent also filed report before the learned XIII Metropolitan Magistrate Court, Egmore, Chennai on 17.06.2024. So far, the petitioner did not receive any referred charge sheet notice.

In view of the above, the learned XIII Metropolitan Magistrate, Egmore, Chennai is directed to issue notice to the petitioner before accepting the report submitted by the respondent. On receipt of the said notice, the petitioner is at liberty to file a protest petition against the closure report. Thereafter, the learned XIII Metropolitan Magistrate, Egmore, Chennai is directed to dispose of the protest petition to be filed by the petitioner in accordance with law.

With the above directions, this criminal revision case is disposed
of.
