A2/15226/2011, dated 24.04.2012, on the file of the 1st respondent and quash the same as illegal, incompetent and without jurisdiction and further direct the 3rd respondent to issue patta to the petitioner for lands in S.Nos. 275/ 1a, 1b, 1c, 1d, 1e1, 1e2, 1e3, 1e4, measuring an extent of 4 acres 10 in Kadambaur Village, Udiyarpalayam Taluk, Ariyalur.

ORDER

This Writ Petition has been filed challenging the order dated 24.04.2012 passed in proceedings No.O.Mu.2/15226/2011 by the first respondent, thereby rejected the request made by the petitioner for transfer of patta.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

The petitioner had purchased the property comprised in Survey Nos.275/1a, 1b, 1c, 1d, 1e1, 1e2, 1e3, 1e4, admeasuring an extent of 4 acres 10 cents in Kadambur Village, Udiyarpalayam Taluk, Ariylaur District. The said land was originally classified as Punja land in the revenue records and stood in the name of one Chinnammal. For the past seventy years, the subject land has been treated as patta land and enjoyed by various persons other than Adi Dravidars. After purchasing the property, the petitioner applied for transfer of patta. On such request, the second and third respondents conducted a detailed enquiry, after issuing notice to the petitioner. During the enquiry, the petitioner also submitted a detailed explanation. After receipt of the report from the second and

third respondents, the first respondent concluded that the subject land was originally assigned in favour of Adi Dravidars and classified as Panchami land. Therefore, it cannot be sold out to any other person other than Adi Dravidars. Since, this condition was violated, the request made by the petitioner for issuance of patta for the subject land was rightly rejected by the first respondent.

4. In view of the above, this Court finds no infirmity or illegality in the order dated 24.04.2012 passed in proceedings No.O.Mu.2/15226/2011 by the first respondent. Thus, the writ petition lacks merits and is liable to be dismissed. Accordingly, this Writ Petition stands dismissed. Consequently, connected miscellaneous petitions are closed.
