ORDER
This criminal original petition has been filed seeking to direct the 2nd respondent not to harass the petitioner under the guise of enquiry based on the complaint given by the 3rd respondent herein.

When the matter was taken up for hearing, the learned Government Advocate (Criminal Side) appearing for the 1st and 2nd respondents, on instructions, submitted that based on the complaint given by one Krishnakumar, current paper enquiry is pending in C.No.1817/PG/DCB North/2025 and the petitioner was called only for enquiry and that the respondent-police are not unnecessarily harassing the petitioner. 2/5

In response, the learned counsel for the petitioner submitted that the petitioner is a sexagenarian and he is the Chief Executive Officer of the company namely, M/s.Chendur Infrastructure Private Limited and due to some dispute in the business transactions, the 3rd respondent herein made a false and exaggerated complaint, based on which, the respondent-police are unnecessarily harassing the petitioner and his family members, particularly his daughter, who gave birth to a child very recently.

In such circumstances, it is for the Investigating Agency to issue appropriate notice to the petitioner under Section 35(3) of BNSS for enquiry and on receipt of such notice, the petitioner shall appear for enquiry and cooperate in the investigation. It is made clear that the petitioner shall not be harassed during the course of enquiry/investigation. If any cognizable offence is made out, the respondent-police shall register a First Information Report and proceed in accordance with law.

5. This criminal original petition stands disposed of accordingly. The respondent-police shall complete the enquiry/investigation within a period of four (4) weeks from the date of receipt of a copy of this order. However, it is made clear that the womenfolk in the petitioner's family shall not be unnecessarily harassed and the petitioner is permitted to be represented by an authorised person from the company.
