Crl.O.P.No.5548 of 2022 Dr.G.JAYACHANDRAN. J, The petitioner is alleged to have developed illegal intimacy with one Sumathy, wife of the Neelagandan alleged to have gone to her house on the date of occurrence at about 06.30 p.m., and forced her to accede to his carnal desire or else he will disclose their relationship and cause disgrace to her. Being offended, the said Sumathy had committed suicide. Whereas the petitioner states that the said Sumathy is known to him since school days and she was running a tailoring shop and except that he has no other intimacy with her. However, the relatives of the said Sumathy suspecting that she committed suicide only because of this petitioner, assaulted him using iron rod and caused injury. After getting treatment for 3 days, the petitioner has given a complaint to the Superintendent of Police on 11.02.2022.

2. The learned Additional Public Prosecutor for the respondent states that the petitioner herein being frequently sending message from his cell phone and tortured the deceased and compelled her to have sexual relationship with him, which has led to her suicide. She further states that the call details of the accused and the deceased yet to be collected and investigation is in nasal stage and prayed for dismissal of this bail petition.

3. On perusing the records, the investigation indicates that the petitioner has forced the deceased to commit suicide and she committed suicide due to torture caused by the petitioner.
