Respondents Prayer:- Writ Petition has been filed under Section 226 of the Constitution of India for issuance of a Certiorarified Mandamus, to call for the records of the first respondent relating to G.O.Ms.No.146, School Education (VI) Department, dated 30.05.2000, quash the same to the limited extent of discrimination between students getting highest marks (first three rank holders) at State Level and students getting highest marks at District Level (First Rank Holder only) and issue consequential directions to follow uniformity at State and District Levels, to the first three rank holders, irrespective of the nature of Schools in which they studied, and further direct the respondents to grant Scholarship to the petitioner to pursue further studies as per Scale fixed in G.O.Ms.No.286, School Education (VI) Department, dated 17.11.

O R D E R

The Petitioner challenges G.O.Ms.No.146, School Education (VI) Department, dated 30.05.2000, by which the first three rank holders who had studied in the Government schools are provided with scholarships in the District Level.

2.The petitioner, in the +2 examination, secured 1174 marks, out of 1200 and stood second, in Salem District. However, he was not given any scholarship, as he had studied in AGN Matriculation Higher Secondary School(Rural School), A. Thottam, Konganapuram, Salem District.

3.Heard both the parties.

4.When the policy of the Government is to encourage the students, who had studied in the Government schools for the award of scholarship and for the said purpose, the impugned Government Order has been passed. Therefore, the said order cannot be questioned by the petitioner, who had studied in a private school. Therefore, the writ petition fails and the same stands dismissed.

No costs.

Consequently, connected miscellaneous petitions are closed.
