This petition is filed to condone the delay of 970 days in re-presenting the above appeal.
2.The learned counsel for the petitioner would submit that due to inadvertence of his office staff, the appeal could not be represented in time. As a result, there is a delay of 970 days had occurred. He has also brought to the notice of this Court that there is a clear finding in favour of the Insurance Company that the claimant has miserably failed to prove that he was travelled as load man at the time of accident. Therefore, it is a fair case for getting success before this Court.
3.Considering the submissions made by the learned counsel for the petitioner, this petition is ordered subject to the condition that the petitioner shall pay a sum of Rs.1,500/- (Rupees One Thousand Five Hundred only) towards cost to the Tamil Nadu Mediation and Conciliation Centre, High Court Building, Chennai, within a period of one week from today, failing which, this petition shall stand dismissed automatically without any further reference to this Court. 20.10.2016 kal T.RAJA, J
