JAYACHANDRAN CRIMINAL MISCELLANEOUS PETITION No.11217 of 2017 IN CRL A.562/2017 MAHALINGAM APPELLANT/PETITIONER Vs STATE BY DEPUTY SUPERINTENDENT OF POLICE RESPONDENT VIGILANCE AND ANTI CORRUPTION CHENNAI CRIME NO.6/2010/AC/CC1 Petition praying that in the circumstances stated therein and in the Memorandum of Grounds in Criminal Revision Case No. on the file of the High Court, the High Court will be pleased to suspend the sentence imposed on the petitioner herein by the learned Special Judge for the cases under the Prevention of Corruption Act at Chennai made in C.C.No.20 of 2011 by Judgment dated 09.08.2017 on her file convicting the Appellant herein for the offence under Sections 7,13(2) read with 13(1) (d) of P.C.
Act 1988 and sentencing him to undergo one year Rigorous Imprisonment and to pay a fine of Rs.1000/- in default to undergo 3 months simple imprisonment for the offence under section 7 of the Prevention of Corruption Act,1988 and also sentencing him to undergo two years Rigours imprisonment and to pay a fine of Rs.1000/- in default to undergo three months simple imprisonment for the offence under Section 13 (2) read with section 13 (1) (d) of the Prevention of Corruption Act 1988 and the sentences of imprisonment for each offence shall run concurrently and enlarge him on bail pending disposal of the above Crl.A.No.562/2017.
Order : This petition coming on for orders upon perusing the petition and the Memorandum of Grounds in Crl.A.562/2017 on the file of the High Court and upon hearing the arguments of MR.L. MAHENDRAN Advocate for the petitioner and of MR. R. RAVICHANDRAN, Government Advocate (Crl.Side) on behalf of the Respondent the court made the following order:-
Seeking to suspend the sentence imposed on the petitioner by the learned Special Judge for the cases under the Prevention of Corruption Act at Chennai made in C.C.No.20 of 2011 dated 09.08.2017, and enlarge the petitioner on bail pending disposal of criminal appeal, the petitioner is before this Court with this petition.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (crl.side) appearing for the respondent.
3. Having regard to the facts and circumstances of the case, this miscellaneous petition is allowed and the order passed by the learned Special Judge for the cases under the Prevention of Corruption Act at Chennai made in C.C.No.20 of 2011 dated 09.08.2017,, is suspended on condition that the petitioner shall execute a bond for a sum of Rs.1,00,000/- (Rupees One lakh only) with two sureties each for a like sum to the satisfaction of the learned Special Judge for the cases under the Prevention of Corruption Act at Chennai. Further, the petitioner shall appear before the trial Court on first working day of every month at 10.30 a.m until further orders.
