The petitioners who was arrested and remanded to judicial custody on 09.01.2023 for the offences punishable under Sections 420 of IPC @ Section 120(b), 406 and 420 of IPC, in Crime No.318 of 2022, seek bail.
2. There are totally three accused involved in this case and the petitioners are arrayed as A1 and A3. The case of the prosecution is that the petitioners along with other accused conspired and cheated the defacto complainant by obtaining 47 numbers of gold chain weighing 1258.240 grams for which, the accused persons have given gold biscuit to the defacto complainant. Later, the defacto complainant came to know that the gold biscuit is a duplicate one, since it is made of copper. Hence the case.
3. The learned counsel for the petitioner would submit that the petitioners are innocent persons and they have been falsely implicated in this case. He would submit that they are ready to abide by any stringent condition that may be imposed by this Court. He would further submit that the petitioners are in the judicial custody from 09.01.2023. The learned Government Advocate (Crl.Side) would submit that the petitioners along with other accused conspired and cheated the defacto complainant by obtaining 47 numbers of gold chain weighing 1258.240 grams for which, the accused persons have given gold biscuit to the defacto complainant. Later, the defacto complainant came to know that the gold biscuit is a duplicate one, since it is made of copper. He would submit that the investigation is still pending and that there is every possibility of tampering the evidence, if bail is granted to the petitioners. Hence, he opposed for grant of anticipatory bail to the petitioners.
5. Taking into consideration the gravity of offence, the amount involved in this case, the investigation is at crucial stage, there is possibility of tampering the witnesses, hampering the investigation, this Court is not inclined to grant anticipatory bail to the petitioners.
