This petition has been filed to direct the respondent to register a case on the basis of the complaint dated 09.04.2016 given by the petitioner.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor appearing for the State.

3. Learned Additional Public Prosecutor submits that on the complaint dated 09.04.2016 given by the petitioner, petition enquiry is pending in CSR No.98/2016. It is seen that this petitioner had agreed to purchase a property from one Rajavalli and had given some advance amount, but the said Rajavalli has neither executed the sale deed nor returned the amount and that when the petitioner demanded money, she has threatened him.

4. In the considered opinion of this Court, the entire dispute appears to be contractual in nature and in order to give criminal colour, the petitioner has stated that he was included. Under such circumstances, no positive direction can be given to the police to register a case.

In the result, this Criminal Original Petition is closed with liberty to the petitioner to workout his remedy in the manner known to law.
