The Petitioner/A2 in Crime No.45 of 2023 registered by the respondent police for the offences originally under Section 174(3) of Code of Criminal Procedure,1973 and subsequently, altered to Section 306 IPC, seeks anticipatory bail.

2. The learned Government Advocate (Criminal Side) stated that the deceased is the co-sister of this Petitioner. She died by hanging after killing her own two children, who were also found dead lying in the floor. The husband of the deceased is working abroad. It is stated that the deceased was residing with the Accused A1/mother in law.

3. Owing to various disputes, she had taken the extreme step of not only killing herself but also her two young children. The report of the Revenue Divisional Officer has been perused. It is seen that there was constant harassment and disputes among all the family members leading to extreme frustration by the deceased.

4. The learned counsel for the Petitioner pointed out that the Accused A1/Mother in law had been granted bail after being arrested. There is also an application filed by the Intervenor and strong objection had been raised. But the investigation will have to be completed.

5. Taking all these factors into consideration and owing to the death of that three unfortunate individuals, I am not inclined to grant anticipatory bail to the Petitioner herein.

6. Accordingly, this Criminal Original Petition stands dismissed. Consequently, connected Criminal Miscellaneous Petition is closed. 14.03.2024 mkn2 2/3
