Crl.O.P.No.4572 of 2024 C.V.KARTHIKEYAN,J.

The petitioner/A3 in Crime No.272 of 2023 registered by the respondent police for the offences punishable under Sections 420, 120B IPC and Section 76(1) of The Chit Funds Act, seeks anticipatory bail.

2. A complaint had been received by the respondent that a amount of Rs.5,00,000/- have been given by cheque to the accused and that same had not been returned.

3. It is stated by the learned Government Advocate (Crl.Side) that similar day 31 separate complainants have come forward and the total amount involved is Rs.1.36 crores. It must be noted that this petitioner is wife of A1 and the second accused is the cousin brother of A1 and therefore, this petitioner is directly involved with A1 and indirectly knows A2.

The learned counsel for the petitioner, had tried to attract the sympathy of the court by stating that the petitioner has three children and that she has to look after them and that she was not at all involved in the business of A1 and that, there are no bank transactions with respect to this petitioner. Those are the aspects which will have to be investigated and it is informed by the respondent that investigation is at an extremely nascent stage. The petitioner should come forward with some bonafide by either disclosing if not the address of her husband or atleast the details about A2 and also disclosing about where the monies have been parked. There is no bonafide in that regard shown.

5. The learned counsel for the petitioner states that A1 had eloped with another lady even before the registration of the first information report and a complaint had been given in that regard. But, it does not accrue to the advantage of the petitioner as so far as the offence in the present FIR is concerned.

6. Taking all the factors into consideration, this Court is not inclined to grant anticipatory bail to the petitioner.
