Writ Petitions filed under Article 226 of the Constitution of India, praying for issuance of writ of Certiorari, directing to call for records relating to orders passed by the 1st respondent in Letter (D) No.851/E7/2005 dated 25.10.2010 and consequential proceedings of the 3rd and 4th respondents in Na.Ka.No.28415/2010/Pa A2 dated 09.11.2010 and in Na.Ka.No.3216/2010/A1 dated 01.12.2010 respectively and quash the same.

COMMONORDER In these two writ petitions, the learned counsel for the petitioners filed memo dated 09.01.2023 stating that the sole petitioner in W.P.No.7281 of 2011 is no more and he is unable to contact the legal heirs of the petitioner therein. He also stated that inspite of his best effort, he is unable to contact the petitioner in W.P.No.7280 of 2011 and therefore, withdrawing his appearance in both the matters. 2.In view of the death of the petitioner in W.P.No.7281 of 2011 the writ petition stood abated. Accordingly, the writ petition is closed as abated leaving it open to the legal representatives of the deceased/petitioner in W.P.No.7281 of 2011 to file appropriate application to come on record and seeking restoration if they are so advised.

3.Insofar as W.P.No.7280 of 2011 is concerned, there is no appearance entered for the petitioner and there is none to prosecute the matter. In the circumstances, this Court is left with no other option except to dismiss the writ petition for non prosecution. Accordingly, W.PNo.7280 of 2011 is dismissed for non-prosecution. 3/5

4.In the result, the writ petition No.7280 of 2011 stands dismissed for non-prosecution and Writ Petition No.7281 stands closed as abated. No costs.
