This petition has been filed to extend the time to comply the conditions imposed in Crl.M.P.No.19933 of 2022 in Crl.O.P.No.27529 of 2022 dated 02.01.2023.

This Court while considering the anticipatory bail granted anticipatory bail to the petitioner who was apprehended arrest for the offences under Sections 406 & 420 of IPC for cheating the defacto complainant to the tune of Rs.6,00,000/- on promise to marry her and arranged bank loan from the HDFC Bank.

This Court on considering the nature of the offence granted anticipatory bail on conditions that the petitioner should deposit a sum of Rs.2,00,000/- to the credit of Crime No.428 of 2022 and thereafter to appear before the respondent police at 10.30 a.m., daily until further orders. The petitioner neither deposited the money nor appeared before the respondent police till date. Though the anticipatory bail order was passed on 14.11.2022, it appears that the petitioner filed an application to modify the order and the same

was allowed on 02.01.2023 and permitted the petitioner to deposit a sum of Rs.2,00,000/- within a period of two weeks from the date of receipt of the Order copy. The petitioner has not deposited the money even after getting extension of time.

Again the petitioner filed the present petition for further extension of time and this petition was filed on 29.03.2023. The conduct of the petitioner is very clear that he is not inclined to comply the condition imposed by this Court while granting anticipatory bail but wants to enjoy the liberty. This Court cannot permit such kind of conduct and hence, the petition for time extension is dismissed. The liberty granted by this Court by an order of anticipatory bail dated 14.11.2022 and further modification on 02.01.2023, shall stand revoked for non compliance of the same.
