ORDER

This civil revision petition has been filed seeking a direction to the learned II Assistant Judge, City Civil Court, Chennai, for speedy disposal of suit in O.S.No.5233 of 2013.

2. The petitioners are the plaintiffs and the respondents are the defendants in the suit. The suit has been filed in the year 2013 for permanent injunction. The grievance of the petitioners is that though the trial has commenced and P.W.1 was examined in chief as long back, there has been no further progress thereafter and the suit is being adjourned from time to time.

3. Considering the limited nature of the relief sought for in this revision petition and the other facts and circumstances of the case, this court is of the view that no notice is necessary as no prejudice would cause to the other side if a https://hcservices.ecourts.gov.in/hcservices/

direction is issued to the court below for early disposal of the original suit.

4. I have heard the learned counsel for the petitioners and also perused the records carefully.

5. In view of the limited nature of the relief sought for and on considering the fact that the trial has already commenced, without going into the merits of the case, this court is inclined to direct the learned Judge to dispose of the original suit at the earliest. Accordingly, the learned II Assistant Judge, City Civil Court, Chennai, is directed to proceed further with the trial of the suit in O.S.No.5233 of 2013 and dispose of the same on merits and in accordance with law, within a period of six months from the date of receipt of a copy of this order. This civil revision petition is disposed of accordingly with the above directions. No costs.
