ORDER : The Court Made the following order :- The petitioner, who is arrayed as Accused No.3, apprehends arrest at the hands of the respondent police for the alleged offence punishable under Section 399 IPC in Crime No.44 of 2017 on the file of the respondent police and hence, prays for anticipatory bail.
2. The case of the prosecution is that the petitioner/A3 along with other accused were planning to commit the offence.
3. The learned counsel for the petitioner submitted that the petitioner is an innocent and he has been falsely implicated in this case. Further, he submitted that there is no previous case against the petitioner and the co-accused have already been arrested and released on bail by the learned Principal Sessions Judge, Vellore in Crl.M.P.No.840 of 2017, dated 27.02.2017.
4. Heard the learned Government Advocate (crl.side).
5. Considering the facts and circumstances of the case and taking note of the fact that the co-accused have already been granted bail on 27.02.2017 in Crl.M.P.No.840 of 2017, this Court is inclined to grant the relief of anticipatory bail to the petitioner.
6. Accordingly, the petitioner is ordered to be released on bail in the event of arrest or on his appearance before the learned Judicial Magistrate No.I, Vellore, within a period of 15 days from the date of receipt of a copy of this order, on his executing a bond for a sum of Rs.10,000/-(Rupees Ten Thousand only) with two sureties each for a like sum to the satisfaction of the learned Magistrate concerned, or to the satisfaction of the respondent police or the Police Officer, who intends to arrest and on further condition the petitioner shall appear before the respondent police daily at 10.30 am., for a period of two weeks and thereafter as and when required for interrogation.
