PRAYER: Criminal Original Petition filed under Section 439(1)(b) of the Code of Criminal Procedure, to modify the condition imposed upon the petitioner shall appear and signed before the respondent police daily at 10.00 a.m. For 30 days by the learned Judicial Magistrate Villupuram in Crl.M.P.No.5494 of 2018 dated 04.12.2018.

O R D E R

This petition has been filed by the petitioner seeking for modification of the condition imposed upon the petitioner shall appear and signed before the respondent police daily at 10.00 a.m. for 30 days by the learned Judicial Magistrate, Villupuram in Crl.M.P.No.5494 of 2018 dated 04.12.2018.

2. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondent.

3. Considering the facts and circumstances of the case and also of the fact that this petitioner has already been reporting before the DCB, Pudukottai in three other cases daily at 4.00 p.m., the petitioner shall report in this case also https://hcservices.ecourts.gov.in/hcservices/

before the DCB, Pudukottai daily at 04.00 p.m. until further orders.

4. The learned counsel for the Intervenor submitted that the defacto complainant has already filed a petition for cancellation of bail. It is left open to the defacto complainant to independently prosecute the said petition and this order will not have any bearing in the cancellation of bail petition filed by the defacto complainant and the same will be considered independently in accordance with law.

5. In view of the above, this Criminal Original Petition is disposed of. Consequently, connected miscellaneous petition is closed.
